Filing a Takedown Notice
If you believe that content available on the Forge platform infringes your copyright, you may submit a takedown notice to our Designated Agent. Your notice must include the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing, with sufficient detail to allow Forge to locate it on the Platform (e.g., URL, listing ID, or order reference).
- Your contact information, including your name, address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
Response Timeline
Upon receipt of a valid takedown notice, Forge will:
- Acknowledge receipt of the notice within 1 business day.
- Remove or disable access to the allegedly infringing material within 3 business days.
- Notify the user who posted the material that it has been removed.
- Provide the user with a copy of the takedown notice and information about filing a counter-notice.
Counter-Notice Procedure
If you believe that material you posted was removed in error or is not infringing, you may file a counter-notice. Your counter-notice must include:
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located, or if your address is outside the United States, the judicial district in which Forge is located (Middle District of Tennessee).
- A statement that you will accept service of process from the person who provided the original takedown notice.
Response to Counter-Notice
Upon receipt of a valid counter-notice, Forge will:
- Forward the counter-notice to the original complainant.
- Inform the complainant that the removed material will be restored in 10 business days unless Forge receives notice that the complainant has filed a court action seeking to restrain the user from engaging in the allegedly infringing activity.
- Restore the removed material between 10 and 14 business days after receiving the counter-notice, unless a court order is obtained by the complainant.
Repeat Infringer Policy
Forge maintains a repeat infringer policy in accordance with the DMCA:
- First valid takedown: Warning and content removal.
- Second valid takedown: 30-day account suspension and content removal.
- Third valid takedown: Permanent account termination.
A takedown is considered "valid" if no counter-notice is filed, or if a counter-notice is filed and the complainant obtains a court order. Takedowns that are successfully countered do not count toward the repeat infringer threshold.
AI-Generated Content Special Notice
Forge's AI design tools generate 3D models algorithmically. While our AI systems are trained to avoid reproducing copyrighted works, the possibility of unintentional similarity to existing works exists.
If you believe an AI-generated design infringes your copyright:
- File a standard takedown notice as described above.
- Include a clear description or image of the original copyrighted work.
- Specify whether the claim is against the 3D model, the visual similarity, or both.
Forge will review AI-generated content claims on a case-by-case basis. Due to the nature of algorithmic generation, unintentional similarities do not necessarily constitute infringement, but Forge will act in good faith to address legitimate claims.
Abuse of DMCA Process
Filing false or fraudulent takedown notices is a violation of the DMCA and may result in liability for damages, including costs and attorney's fees. Forge reserves the right to:
- Report fraudulent takedown notices to the affected parties.
- Terminate the accounts of users who abuse the DMCA process.
- Seek damages for knowingly false takedown notices under 17 U.S.C. § 512(f).
